SECTION 1 — OVERVIEW AND ACCEPTANCE OF TERMS
Welcome to European Engine Parts. The terms "European Engine Parts," "we," "us," and "our" refer to European Engine Parts and, where applicable, the legal entity operating EuropeanEngineParts.com.
These Terms of Service ("Terms") govern your access to and use of our website, online store, products, information, content, customer service, and related services (collectively, the "Services").
By accessing the Services, creating an account, submitting an order, or purchasing a product from us, you agree to these Terms and all policies expressly incorporated into them, including our Privacy Policy and Return & Refund Policy.
If you do not agree to these Terms, you must not use the Services or submit an order.
Nothing in these Terms is intended to waive, restrict, or exclude any right or remedy that cannot lawfully be waived, restricted, or excluded under applicable law.
SECTION 2 — ELIGIBILITY AND ACCOUNT INFORMATION
You represent that you are legally capable of entering into a binding contract in the jurisdiction where you reside.
You agree to provide accurate, current, and complete information when creating an account, requesting technical assistance, checking vehicle fitment, or placing an order.
You are responsible for safeguarding your account credentials and for activity conducted through your account unless applicable law provides otherwise.
You may not impersonate another person, use another person's payment information without authorization, provide false vehicle or identity information, or use the Services for fraudulent or unlawful purposes.
We reserve the right to suspend or terminate an account reasonably associated with fraud, abuse, unlawful conduct, attempted payment fraud, misuse of our Services, or a material violation of these Terms.
SECTION 3 — CONSUMER AND COMMERCIAL CUSTOMERS
European Engine Parts sells products to both individual consumers and commercial customers.
For purposes of these Terms, a "Consumer Customer" means an individual purchasing goods primarily for personal, family, or household use where applicable consumer-protection law treats the transaction as a consumer transaction.
A "Commercial Customer" means a purchaser acquiring products primarily for business, professional, trade, resale, racing-business, repair-shop, engine-building, dealership, fleet, manufacturing, or other commercial purposes.
Certain warranty disclaimers, remedy limitations, indemnification obligations, and limitations of liability contained in these Terms apply more broadly to Commercial Customers than they may to Consumer Customers.
Nothing in these Terms shall be interpreted to eliminate rights afforded to a Consumer Customer that applicable law prohibits us from waiving.
SECTION 4 — AUTOMOTIVE PARTS AND FITMENT INFORMATION
Automotive and engine-component compatibility can depend on numerous factors, including vehicle identification number, engine code, engine variant, chassis code, production date, model year, market specification, displacement, transmission, emissions specification, prior engine replacement or modification, machining history, crankshaft dimensions, cylinder dimensions, bearing dimensions, and manufacturer supersessions.
Vehicle or engine fitment information displayed on our website is provided as a reference to assist customers in identifying potentially compatible products. Unless European Engine Parts expressly provides a written fitment guarantee for a particular transaction, fitment information should not be considered a substitute for verification by the customer or the customer's qualified installer.
Customers are responsible for verifying product compatibility with the specific vehicle, engine, and application before opening manufacturer-sealed packaging or attempting installation.
When available, customers should verify the manufacturer's part number, dimensions, engine code, chassis information, production date, and other application-specific information before installation.
A vehicle model or engine family may use more than one version of a component. The fact that a product is generally associated with a particular make, model, engine family, or chassis does not necessarily mean that it is correct for every vehicle or engine within that category.
SECTION 5 — PART NUMBERS, SUPERSESSIONS, AND MANUFACTURER INFORMATION
Manufacturer part numbers may be superseded, replaced, updated, or cross-referenced over time.
Where we display an original equipment number, manufacturer number, interchange number, or cross-reference number, that information is provided for identification purposes.
Customers should not assume that two components are identical solely because a third-party catalog, search engine, marketplace listing, automated fitment tool, or other source identifies them as interchangeable.
Manufacturer catalogs and application data may contain errors or may be revised without notice.
European Engine Parts may update product listings when new manufacturer information becomes available.
SECTION 6 — TECHNICAL ASSISTANCE
European Engine Parts may provide general product, specification, application, or fitment assistance as a convenience to customers.
Unless expressly stated in writing as a specific guarantee, such assistance is informational and does not replace inspection, measurement, diagnosis, or professional judgment by a qualified automotive technician, machinist, or engine builder.
The accuracy of any fitment assistance depends upon the accuracy and completeness of the information supplied by the customer.
If a customer provides an incorrect or incomplete VIN, engine code, crankshaft size, bore size, production date, vehicle configuration, modification history, or other relevant information, European Engine Parts is not responsible for an incorrect recommendation resulting from that inaccurate or incomplete information to the extent permitted by law.
SECTION 7 — PRE-INSTALLATION INSPECTION
Automotive and engine components must be inspected and verified before installation.
Before installation, the customer and installer should verify all information reasonably applicable to the component, including the product number, quantity, dimensions, size designation, orientation, clearances, mating surfaces, oil passages, locating features, fastener requirements, and compatibility with the components to which the product will be fitted.
For precision engine components, nominal size designations such as standard, oversize, undersize, or additional-clearance specifications do not eliminate the need for appropriate measurement and verification.
Measurements, clearances, machining requirements, torque specifications, surface preparation, lubrication, assembly procedures, and other technical requirements should be determined using appropriate measuring equipment and the applicable manufacturer or professional service information.
If a component appears incorrect, damaged, materially different from the ordered product, or otherwise unsuitable, installation must stop until the issue has been resolved.
Installation of a component after a discrepancy should reasonably have been discovered may affect the availability of a claim to the extent the installation or continued use caused or increased the claimed loss.
SECTION 8 — PROFESSIONAL INSTALLATION AND ENGINE ASSEMBLY
Many products sold by European Engine Parts are precision automotive components requiring specialized knowledge, measurements, tools, machining, assembly procedures, and installation techniques.
We strongly recommend installation by a qualified automotive technician, machinist, or professional engine builder when appropriate for the product.
The customer and installer are responsible for following applicable service information and manufacturer instructions and for determining proper tolerances, clearances, torque values, lubrication, cleanliness, machining procedures, component preparation, break-in procedures, and related requirements.
European Engine Parts does not perform or supervise the customer's installation and therefore cannot control installation conditions, engine condition, machining quality, cleanliness, lubrication, calibration, tuning, operating conditions, or workmanship.
To the fullest extent permitted by law, European Engine Parts is not responsible for a failure or damage caused by improper installation, incorrect machining, incorrect tolerances or clearances, contamination, inadequate lubrication, oil starvation, overheating, over-revving, improper tuning, detonation, incorrect assembly, improper fastener torque, incompatible modifications, misuse, abuse, neglect, improper maintenance, or other causes unrelated to a defect for which European Engine Parts is legally responsible.
SECTION 9 — MODIFIED, PERFORMANCE, AND MOTORSPORT APPLICATIONS
Some products sold through the Services may be used in modified, performance, competition, or motorsport applications.
Modified and high-performance vehicles and engines may operate outside the conditions for which original components, replacement components, or surrounding systems were originally designed.
Performance modifications may increase stresses, temperatures, loads, operating speeds, cylinder pressures, vibration, wear, or other demands placed on an engine or vehicle.
Unless expressly stated otherwise in a written warranty applicable to a specific product, European Engine Parts does not guarantee a particular horsepower level, torque output, racing result, service life, performance increase, or ability of a component to withstand a particular modified operating condition.
Motorsport and competition activities involve significant risk. Customers engaging in such activities assume the risks inherent in those activities to the fullest extent permitted by law.
Nothing in this section limits liability that applicable law prohibits us from limiting.
SECTION 10 — EMISSIONS AND REGULATORY COMPLIANCE
Certain automotive products may be regulated by federal, state, provincial, territorial, or local emissions, environmental, highway-safety, or vehicle-equipment laws.
The availability of a product through our store does not, by itself, constitute a representation that the product may legally be installed or used on every vehicle in every jurisdiction.
Customers are responsible for determining whether a product is lawful for their intended application and jurisdiction.
European Engine Parts does not authorize customers to remove, bypass, defeat, render inoperative, or unlawfully modify an emissions-control device or system.
A designation such as "race," "competition," "off-road," or similar terminology does not authorize conduct prohibited by law.
Where a product is represented as having a California Air Resources Board Executive Order or other emissions approval, any such approval applies only to the vehicles, engines, configurations, model years, and conditions covered by the applicable approval.
European Engine Parts may refuse, restrict, or cancel a transaction when we reasonably believe that completing the transaction would violate applicable law or regulatory requirements.
SECTION 11 — PRODUCT SAFETY AND WARNINGS
Automotive components may contain or expose users to metals, chemicals, oils, coatings, dust, residues, or other materials requiring appropriate handling.
Customers and installers are responsible for reviewing and following manufacturer warnings and instructions supplied with a product.
Use appropriate personal protective equipment and safe workshop procedures when handling or installing automotive components.
Products should be kept away from children and used only for their intended automotive or mechanical application.
Where required, product-specific regulatory warnings, including applicable California Proposition 65 warnings, may appear on the product, packaging, product page, checkout process, or accompanying documentation.
SECTION 12 — PRODUCT PHOTOGRAPHS, PACKAGING, AND MANUFACTURER CHANGES
We make reasonable efforts to accurately display the products sold through our Services.
However, manufacturers may change packaging, labeling, logos, markings, coatings, finishes, colors, country of manufacture, production facilities, minor design details, or other non-material characteristics without notice.
A difference in packaging or other non-material characteristic does not necessarily mean that a product is incorrect, counterfeit, used, or materially different.
Product photographs may show representative packaging or a representative version of a product.
We will not knowingly substitute a materially different product for the product ordered without obtaining any consent required by applicable law.
SECTION 13 — THIRD-PARTY MANUFACTURERS AND TRADEMARKS
European Engine Parts sells products manufactured by third parties.
All third-party trademarks, vehicle names, manufacturer names, logos, part numbers, and other intellectual property belong to their respective owners.
References to manufacturers such as vehicle manufacturers or component manufacturers are used for product identification, compatibility, comparison, or descriptive purposes.
Unless expressly stated otherwise, the use of a manufacturer's name or trademark does not imply that European Engine Parts is sponsored by, affiliated with, endorsed by, or an authorized dealer of that manufacturer.
SECTION 14 — ORDERS AND CONTRACT FORMATION
Submitting an order constitutes an offer to purchase the products identified in the order.
Receipt of an automated order confirmation or payment authorization does not necessarily constitute final acceptance of the order.
Unless applicable law requires otherwise or we expressly state otherwise in writing, we may accept an order by shipping the product or providing an express notice that the order has been accepted.
We reserve the right, before acceptance, to reject or cancel an order because of inventory errors, supplier availability, pricing errors, suspected fraud, payment issues, export restrictions, regulatory restrictions, product discontinuation, or other legitimate business reasons.
If we cancel an order after payment has been collected, we will provide the refund required by applicable law.
We may limit quantities or refuse transactions reasonably appearing to involve fraud, unauthorized payment activity, unlawful conduct, or misuse of our Services.
SECTION 15 — SPECIAL ORDERS AND BACKORDERS
Certain products may be special-order, supplier-order, imported-to-order, made-to-order, or backordered products.
Any special cancellation or return restriction applicable to such a product will be disclosed before purchase where required by law.
Estimated supplier, manufacturing, import, and availability dates are estimates unless expressly represented as guaranteed.
If we cannot ship an order within the time represented to the customer, we will provide any delay notice, cancellation opportunity, or refund required by applicable law.
SECTION 16 — PRICING, TAXES, AND FEES
Prices may change without notice before an order is submitted.
The price applicable to an accepted order will be the price displayed or otherwise agreed upon for that transaction, subject to correction of obvious errors before acceptance and applicable law.
Where required by law, advertised prices will include mandatory charges other than permitted exclusions such as applicable government-imposed taxes and separately disclosed shipping charges.
Applicable sales tax, use tax, VAT, customs duties, import taxes, brokerage charges, government fees, and shipping charges may be added or collected where legally permitted and applicable.
Promotional codes, discounts, and special pricing may be subject to separate eligibility requirements, expiration dates, product exclusions, quantity restrictions, and other disclosed conditions.
SECTION 17 — PAYMENT
You represent that you are authorized to use the payment method submitted for an order and that the payment and billing information supplied is accurate.
We may use third-party payment processors and fraud-prevention services to process or evaluate transactions.
Payment authorization does not guarantee that an order will be accepted.
We reserve the right to request additional verification when reasonably necessary to prevent payment fraud or unauthorized transactions.
Nothing in these Terms eliminates rights a customer may have under applicable credit-card, payment-services, or consumer-protection law.
SECTION 18 — SHIPPING AND DELIVERY
Shipping and delivery dates are estimates unless expressly stated otherwise.
Carrier transit times begin after an order has been shipped and are separate from any order-processing or sourcing period.
Customers are responsible for providing an accurate and complete shipping address.
European Engine Parts is not responsible, to the extent permitted by law, for additional costs or delays caused by an incorrect or incomplete address provided by the customer.
Carrier delays, weather, customs processing, government action, labor disruptions, natural disasters, or other events outside our reasonable control may affect delivery.
Nothing in these Terms eliminates a customer's statutory rights relating to delayed or unshipped internet orders.
Title and risk of loss will transfer in accordance with applicable law and the applicable shipping arrangement.
A carrier scan showing delivery may be considered evidence of delivery but does not eliminate rights or remedies that applicable law provides.
Customers should promptly notify us of missing, damaged, or materially incomplete shipments so that we can investigate and, where appropriate, preserve a carrier claim.
SECTION 19 — INTERNATIONAL ORDERS
For international shipments, the customer may be considered the importer of record unless otherwise expressly stated.
The customer is responsible for complying with applicable import, customs, vehicle, product, tax, and regulatory requirements in the destination jurisdiction.
Customs duties, import taxes, VAT, brokerage charges, storage charges, customs examination fees, and similar government or carrier charges are the customer's responsibility unless expressly included in the order.
We are not responsible for delays caused by customs authorities or other governmental agencies to the extent permitted by law.
Customers may not purchase, export, re-export, transfer, or use products in violation of United States export-control, sanctions, or other applicable trade laws.
SECTION 20 — RETURNS AND REFUNDS
Returns are governed by our Return & Refund Policy, which is incorporated into these Terms.
For standard discretionary returns, a return request must generally be submitted within 14 days after delivery.
To qualify for a standard discretionary return, the product must be unopened, unused, uninstalled, in its original manufacturer packaging, and otherwise satisfy the conditions stated in our Return & Refund Policy.
Approved standard returns are subject to a 15% restocking fee.
Unless the return results from an error for which European Engine Parts is responsible or applicable law provides otherwise, the customer is responsible for return shipping and original shipping charges are non-refundable.
Opened, installed, used, tested, modified, or damaged products are not eligible for a standard discretionary return.
Claims concerning an incorrect product, shipping damage, or an alleged product defect are handled separately from ordinary discretionary returns.
The 15% restocking fee will not be applied where doing so would violate applicable law or where European Engine Parts determines that a return resulted from our error and the circumstances warrant a full refund.
Nothing in our Return & Refund Policy or these Terms limits warranty rights, defective-product remedies, or other statutory rights that cannot legally be restricted.
Returns must not be shipped without following the return instructions supplied by European Engine Parts.
SECTION 21 — DEFECT CLAIMS AND PRESERVATION OF EVIDENCE
If a customer believes that a product may be defective, installation or operation should stop as soon as reasonably practical to prevent additional damage.
The customer should promptly contact European Engine Parts at info@europeanengineparts.com.
To allow a fair investigation, the customer should retain the allegedly defective component, its packaging, labels, related components where reasonably relevant, purchase records, installation invoices, machining records, measurements, photographs, diagnostic results, and other evidence reasonably relevant to the claimed failure.
Where an engine or component failure is alleged, information concerning installation, machining, clearances, lubrication, tuning, operating conditions, and related components may be reasonably necessary to determine the cause of the failure.
Customers should not intentionally destroy, discard, materially alter, or return an allegedly defective component to another party after being asked to preserve it for a reasonable inspection.
Failure to preserve relevant evidence may be considered when evaluating a claim to the extent that the loss of evidence materially prevents a reasonable investigation.
A return authorization or an agreement to inspect a product is not an admission that the product is defective and is not a promise to reimburse labor, machining, towing, diagnostic, or other consequential expenses.
SECTION 22 — MANUFACTURER WARRANTIES
Certain products may be accompanied by a warranty offered by the product manufacturer.
Manufacturer warranties are provided by the applicable manufacturer and are subject to that manufacturer's terms, limitations, exclusions, proof requirements, geographic restrictions, and claim procedures.
Unless European Engine Parts expressly issues a separate written warranty for a particular product, references to a manufacturer's warranty do not mean that European Engine Parts has issued its own warranty of the same scope or duration.
Manufacturer warranty eligibility may vary depending upon product, manufacturer, sales channel, country, region, installation, intended use, or other conditions imposed by the manufacturer.
Where appropriate, European Engine Parts may assist a customer in communicating or submitting documentation to a manufacturer, but such assistance does not guarantee that the manufacturer will approve a warranty claim.
Nothing in this section limits obligations imposed directly upon European Engine Parts by applicable non-waivable law.
SECTION 23 — WARRANTY DISCLAIMER FOR COMMERCIAL CUSTOMERS
THIS SECTION APPLIES TO COMMERCIAL CUSTOMERS TO THE FULLEST EXTENT PERMITTED BY LAW.
EXCEPT FOR AN EXPRESS WRITTEN WARRANTY SPECIFICALLY ISSUED BY EUROPEAN ENGINE PARTS, OR A MANUFACTURER WARRANTY THAT MAY APPLY, PRODUCTS SOLD TO COMMERCIAL CUSTOMERS ARE PROVIDED "AS IS" AND "WITH ALL FAULTS."
TO THE FULLEST EXTENT PERMITTED BY LAW, EUROPEAN ENGINE PARTS DISCLAIMS ALL IMPLIED WARRANTIES APPLICABLE TO COMMERCIAL TRANSACTIONS, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY, THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTY ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.
NO ORAL STATEMENT, INFORMAL TECHNICAL ASSISTANCE, FITMENT DISCUSSION, PRODUCT RECOMMENDATION, OR OTHER COMMUNICATION CREATES A WARRANTY UNLESS IT IS EXPRESSLY IDENTIFIED AS A WARRANTY IN WRITING BY AN AUTHORIZED REPRESENTATIVE OF EUROPEAN ENGINE PARTS.
This section does not disclaim an express warranty that applicable law does not permit us to disclaim.
SECTION 24 — CONSUMER WARRANTY RIGHTS
For Consumer Customers, products are subject to any warranties and remedies required by applicable consumer-protection law.
European Engine Parts does not disclaim or restrict an implied warranty, express warranty, statutory remedy, or other consumer right to the extent applicable law prohibits such disclaimer or restriction.
Problems caused by misuse, unauthorized or unreasonable use, improper installation, improper modification, lack of maintenance, improper machining, accidents, or other conditions occurring after sale may be excluded from warranty coverage to the extent permitted by applicable law.
The existence of our 14-day discretionary return period does not mean that all legal warranty rights expire after 14 days.
The discretionary return period and warranty rights are separate matters.
SECTION 25 — LABOR, INSTALLATION, AND RELATED EXPENSES
Except where expressly agreed to in writing by European Engine Parts or required by applicable law, approval of a product return, replacement, refund, or warranty claim does not include reimbursement for labor or other expenses associated with diagnosing, removing, installing, reinstalling, machining, transporting, or testing the product.
To the fullest extent permitted by law, European Engine Parts is not responsible for labor charges, machine-shop charges, diagnostic charges, removal or reinstallation costs, towing, storage, rental vehicles, transportation expenses, vehicle downtime, loss of use, lost profits, lost revenue, lost business opportunities, or similar incidental or consequential expenses arising from a product issue.
Customers should not incur substantial repair or replacement expenses in reliance upon an anticipated reimbursement from European Engine Parts unless reimbursement has first been expressly authorized in writing.
Nothing in this section excludes damages or remedies that applicable law prohibits us from excluding.
SECTION 26 — LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EUROPEAN ENGINE PARTS AND ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THE SERVICES, A PRODUCT, OR A TRANSACTION.
FOR COMMERCIAL CUSTOMERS, TO THE FULLEST EXTENT PERMITTED BY LAW, EUROPEAN ENGINE PARTS' AGGREGATE LIABILITY ARISING OUT OF A PARTICULAR PRODUCT OR TRANSACTION SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID TO EUROPEAN ENGINE PARTS FOR THE PRODUCT GIVING RISE TO THE CLAIM.
FOR CONSUMER CUSTOMERS, ANY LIMITATION OF LIABILITY APPLIES ONLY TO THE EXTENT PERMITTED BY THE LAW GOVERNING THE TRANSACTION.
THESE LIMITATIONS APPLY REGARDLESS OF WHETHER A CLAIM IS ASSERTED IN CONTRACT, WARRANTY, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, OR ANOTHER LEGAL THEORY, BUT ONLY TO THE EXTENT SUCH LIABILITY MAY LAWFULLY BE LIMITED.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR FRAUD, WILLFUL INJURY, VIOLATION OF LAW, OR OTHER LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
SECTION 27 — COMMERCIAL CUSTOMER INDEMNIFICATION
To the fullest extent permitted by law, a Commercial Customer agrees to defend, indemnify, and hold harmless European Engine Parts and its owners, officers, employees, affiliates, and agents from third-party claims, liabilities, damages, judgments, losses, and reasonable legal expenses arising from the Commercial Customer's unlawful resale, unlawful modification, improper installation, misuse of a product, violation of applicable emissions or vehicle law, false product representations made by the Commercial Customer to its own customer, or material breach of these Terms.
This obligation does not require a Commercial Customer to indemnify European Engine Parts for liability that applicable law requires European Engine Parts to bear.
SECTION 28 — RESELLERS, REPAIR SHOPS, AND ENGINE BUILDERS
A customer who resells, installs, modifies, assembles, or incorporates a product into another vehicle, engine, product, or service is independently responsible for the representations, warranties, installation work, services, and legal obligations it provides to its own customer.
A reseller, repair shop, machinist, or engine builder may not represent that European Engine Parts has approved, guaranteed, certified, or warranted that party's workmanship or completed assembly unless European Engine Parts expressly agrees in writing.
Commercial Customers are responsible for maintaining any licenses, permits, insurance, technical qualifications, and regulatory approvals required for their own activities.
SECTION 29 — FORCE MAJEURE
European Engine Parts will not be liable for delay or failure to perform caused by circumstances outside its reasonable control, including natural disasters, wildfire, flood, earthquake, severe weather, acts of government, war, terrorism, civil disturbance, labor disruption, carrier interruption, port congestion, customs delay, supplier failure, widespread transportation disruption, power failure, communication failure, cyberattack, epidemic, pandemic, or material shortage.
This provision does not eliminate any cancellation, refund, or other right that applicable law requires us to provide despite such an event.
SECTION 30 — ERRORS, INACCURACIES, AND OMISSIONS
We attempt to keep product descriptions, fitment information, specifications, availability, pricing, and other information accurate.
However, typographical, catalog, data-entry, manufacturer, fitment, pricing, or technical errors may occasionally occur.
We may correct errors and update information.
Before an order has been accepted, we may cancel or decline an order affected by a material pricing, availability, or product-information error and refund any payment collected as required by law.
After acceptance, nothing in this section permits European Engine Parts to avoid obligations that applicable law imposes with respect to the accepted transaction.
SECTION 31 — FRAUDULENT TRANSACTIONS AND CHARGEBACKS
European Engine Parts may investigate transactions that reasonably appear fraudulent, unauthorized, or abusive.
Customers should contact us promptly if they believe a billing or order error has occurred.
Nothing in these Terms prevents a customer from exercising a legitimate dispute or chargeback right provided by applicable law or a payment provider.
However, knowingly making a false payment dispute, false non-delivery allegation, fraudulent return, substituted-product return, or other fraudulent claim may result in account termination and may be reported or pursued as permitted by law.
SECTION 32 — THIRD-PARTY SERVICES AND LINKS
The Services may contain links to or integrations with third-party websites, payment providers, shipping carriers, manufacturers, catalog providers, or other services.
European Engine Parts does not control those third parties and is not responsible for their independent content, policies, availability, security, representations, or conduct.
Customers should review the terms and policies applicable to third-party services they choose to use.
SECTION 33 — SHOPIFY
European Engine Parts uses Shopify technology to provide portions of its online store and Services.
Sales conducted through our store are transactions between the customer and European Engine Parts, not between the customer and Shopify.
Shopify is not the seller of the automotive products offered by European Engine Parts.
Nothing in these Terms creates an obligation on the part of Shopify beyond any obligation Shopify independently owes under its own agreements or applicable law.
SECTION 34 — INTELLECTUAL PROPERTY
The content of the Services, including original text, graphics, photographs, designs, compilations, logos, site organization, and other materials created or owned by European Engine Parts, is protected by applicable intellectual-property law.
You may use the Services for legitimate personal or commercial purchasing purposes.
You may not reproduce, republish, scrape, systematically extract, distribute, sell, reverse engineer, or commercially exploit protected European Engine Parts content without permission except where applicable law permits such activity.
Third-party product images, trademarks, manufacturer information, and other materials remain the property of their respective owners.

To the extent permitted by applicable law, these Terms and transactions with European Engine Parts will be governed by the laws of the State of California, without regard to conflict-of-law principles that would require application of another jurisdiction's law.

Nothing in this section deprives a Consumer Customer of a mandatory legal protection or forum right that cannot lawfully be waived.
SECTION 41 — INFORMAL DISPUTE RESOLUTION
Before initiating substantial litigation, we encourage the parties to attempt in good faith to resolve the dispute informally.
A customer may begin the process by emailing info@europeanengineparts.com with the customer's name, order number, nature of the dispute, relevant documentation, and requested resolution.
European Engine Parts may request additional information reasonably necessary to investigate the matter.
Nothing in this section prevents either party from filing a small claims action, seeking urgent injunctive relief when appropriate, complying with a legal deadline, or exercising another right that applicable law does not permit these Terms to restrict.
SECTION 42 — SEVERABILITY
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary, and the remaining provisions will remain in effect.
SECTION 43 — WAIVER
A failure by European Engine Parts to enforce a provision of these Terms on one occasion does not constitute a waiver of that provision or of the right to enforce it later.
A waiver is effective only to the extent expressly made.

If a product-specific written warranty expressly conflicts with the general warranty provisions of these Terms, the product-specific warranty controls with respect to the matter addressed by that warranty.
If our Return & Refund Policy expressly conflicts with the general return provisions of these Terms, the Return & Refund Policy controls with respect to discretionary returns, except to the extent applicable law requires otherwise.
